VII - 9.61 - Policy on Reinstatement for Regular Exempt Employees

I. Purpose

To establish implementation procedures for BOR Policy VII-9.61-Policy on Reinstatement for Regular Exempt Employees which establishes the circumstances under which former exempt employees are re-appointed to regular exempt positions.

II. Applicability

This procedure applies to former Bowie State University (BSU), USM and/or State service regular exempt employees who return to regular exempt positions within a specified period of time following a period of separation from BSU, USM and/or State service.

III. Duration of Reinstatement Status

Former regular exempt employees are eligible for reinstatement status to BSU employment for three (3) years from the date of separation from regular BSU, USM and/or State service.

IV. Credit for Proper Service

A reinstated employee shall receive full credit for prior BSU, USM and/or State service as applies to service time and sick leave balance. Refer to the following policies for specific leave and salary provisions: VII-7.45-Policy on Sick Leave, and VII-9.60-Policy on Salary Upon Reinstatement.

V. Guidelines and Standards

A. Eligible former employees must adhere to established BSU hiring guidelines to include participation in the BSU's competitive recruitment process.

B. Former employees must meet the minimum qualifications for desired position.

C. Former employees must have a demonstrated record of satisfactory work history.

D. The Senior Director of Human Resources shall ensure that re-employed individuals receive their entitlement to the appropriate rate for accrual of annual leave earnings under BOR VII-1.31-Policy on Layoff and Recall of Exempt Employees.

VI. Other Related Policies

Refer to Policy on Family and Medical Leave, VII-7.50 and Policy on Leave of Absence Without Pay, VII-7.12 for coordination of other leave benefits with this policy.
